Terms of Service

By downloading, installing, accessing, or using WhatsGen ("the App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Yap Studios ("we," "us," or "our").

• You must be at least 17 years old to use WhatsGen. This minimum age aligns with the App Store age rating and reflects that the App discusses dating, relationships, and other mature social scenarios. If you are under 17, you must not download, access, or use the App
• By using the App, you represent and warrant that you are at least 17 years old, are not prohibited from using the App under any applicable law, and have the legal capacity to enter into these Terms
• If you do not agree to these Terms, you must not use the App

WhatsGen is an AI-powered conversation practice application designed to help users develop and refine their texting and social communication skills in a low-pressure, judgment-free environment.

Features

• AI Persona Conversations — Practice texting with AI-generated personas across four modes: Social, Dating/Rizz, Professional, and Language Practice
• Curated Personas — Access to a catalog of 40+ AI personas with distinct personalities, communication styles, and behavioral patterns
• Custom Personas — Create or customize AI personas based on your specific practice scenarios
• Voice Input— Dictate messages using on-device speech-to-text. Voice-to-text is processed entirely on your iPhone using Apple's Speech Recognition framework; dictation audio never leaves your device, and only the transcribed text you choose to send is transmitted to our backend.
• Voice Messages — Record and send audio messages in chats. Voice-message recordings are uploaded to and stored in our backend so they can be played back in your conversation, and are deleted when you delete the message, the conversation, or your account.

Important Disclaimers

WhatsGen is designed for practice and entertainment purposes only. The App is not a substitute for:

• Professional therapy, counseling, or mental health services
• Legal, medical, financial, or relationship advice
• Real human relationships or social connections

You should not rely on AI-generated responses for real-world decisions. If you need professional help, please consult a qualified professional.

To use WhatsGen, you must create an account.

• Authentication — You may sign in with Apple, sign in with Google, or create an account with your email
• Account accuracy — You are responsible for the accuracy of the information associated with your account
• Account security — You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access
• One account per person — Creating multiple accounts to circumvent bans, subscription requirements, or free trial eligibility is prohibited

You agree to use WhatsGen only for lawful purposes and in accordance with these Terms. You agree not to:

• Generate harmful content — Attempt to make AI personas generate content that promotes violence, hatred, discrimination, harassment, self-harm, or illegal activities
• Exploit AI systems — Attempt to bypass persona safety boundaries, extract system prompts, use prompt injection techniques, or manipulate AI personas into generating harmful, misleading, or inappropriate content
• Engage in illegal activity — Use the App to plan, facilitate, or discuss illegal activities, including but not limited to fraud, stalking, or harassment
• Harass or impersonate — Use conversations or persona features to harass, threaten, or impersonate real individuals
• Automate access — Use bots, scrapers, or automated tools to access the App, send messages, or extract data
• Reverse engineer — Decompile, disassemble, reverse engineer, or attempt to derive the source code of the App, its AI systems, or persona system prompts
• Circumvent restrictions — Bypass paywalls, subscription requirements, free trial eligibility, or account restrictions through any means, including creating multiple accounts
• Redistribute content — Commercially exploit, sublicense, or redistribute AI-generated responses outside the App without authorization

Violation of this policy may result in immediate account suspension or permanent termination without notice or refund.

WhatsGen uses artificial intelligence to generate all persona responses. How chat is generated depends on your platform: on iPhone, chat replies are generated on-device by a bundled MLX-quantized Llama 3.2 model and your chat messages are never transmitted off your device; on Android, chat replies are generated by our secure cloud AI provider (DeepInfra, Qwen3-Next-80B) — your messages are sent over an encrypted connection to generate the reply and are not used to train any model. Optional features (conversation reviews, custom persona generation, persona tweaks) use DeepInfra-hosted Qwen (Qwen3-Next-80B) on both platforms. All cloud processing is disclosed in our privacy policy. By using the App, you acknowledge and agree that:

• AI, not human — All persona responses are generated by artificial intelligence, not real humans. Personas are entirely fictional characters created for communication practice
• No professional advice — AI-generated responses do not constitute professional advice of any kind. This includes but is not limited to psychological, legal, medical, financial, relationship, or career advice
• No accuracy guarantee — AI responses may contain factual inaccuracies, inconsistencies, outdated information, or errors. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content
• Practice purposes only — The App is designed to help you practice communication skills. Results may not directly translate to real-world interactions with real people
• Content variability — AI personas may occasionally produce unexpected, off-character, or repetitive responses. We continuously work to improve quality but cannot guarantee perfect consistency
• No endorsement — Opinions, suggestions, or viewpoints expressed by AI personas do not reflect the views of Yap Studios and should not be attributed to us

Subscription Required

• WhatsGen is a paid application. Full access to the App — all AI personas, custom persona creation, and chat practice — requires an active WhatsGen Pro subscription. There is no ongoing free usage tier; new accounts receive a one-time 24-hour free-use window (measured from account creation, non-renewable, with capped feature access), and ongoing access requires a subscription — typically started through a 3-day free trial (see below) that converts to a paid subscription.

WhatsGen Pro Subscription

• WhatsGen Pro unlocks the entire App: all AI personas, custom persona creation, AI-initiated conversations, and chat practice.
• Fair-use chat limits. WhatsGen Pro is intended for personal, conversational practice. To keep the Service available and affordable and to prevent automated abuse, chat is subject to reasonable daily usage limits and automated anti-abuse and cost controls. These limits are set generously, and the vast majority of subscribers will never reach them in normal personal use. We may, at our reasonable discretion, throttle, temporarily pause, or restrict AI features for accounts with excessive, automated, or abusive usage, or usage that would impose disproportionate costs on the Service. Reaching a usage limit does not entitle you to a refund, and we may adjust these limits over time.
• Monthly plan: $9.99 USD per month
• Annual plan: $59.99 USD per year (equivalent to $5.00/month, approximately 50% off the monthly plan)

Free Trial

• New subscribers may be eligible for a free trial of WhatsGen Pro — 7 days on the annual plan, 3 days on the monthly plan
• The free trial provides full access to all Pro features during the trial period
• If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription at the selected plan price ($9.99/month or $59.99/year)
• Free trials are limited to one per Apple ID per 12-month period. Apple enforces this restriction at the App Store level — once you redeem a free trial, you will not be eligible for another trial of this subscription on the same Apple ID until the eligibility window resets. WhatsGen has no ability to grant additional trials.

Service Availability & Cost Limits

• Chat generation (platform-dependent). On iPhone, WhatsGen chat replies are generated entirely on-device by a bundled MLX-quantized Llama 3.2 model, and are unaffected by cloud provider outages or cost ceilings. On Android, chat replies are generated by our cloud AI provider (DeepInfra) and are therefore subject to the per-account usage limits and provider availability described in this section.
• Global daily cost ceiling (analysis features). Optional cloud-analysis features (conversation reviews, custom persona generation, persona tweaks) operate under a global daily cloud-AI budget. If aggregate cloud usage across all users exceeds this ceiling on a given day, these analysis features may be temporarily paused for the remainder of that UTC day. Service typically resumes at 00:00 UTC the following day.
• Per-account usage limits. To prevent abuse and keep the Service sustainable, each account is subject to a daily message limit and an automated per-account daily cost limit on AI features. These limits are set generously for normal personal practice; if an account reaches a limit, affected AI features may be paused until the limit resets at 00:00 UTC. We may adjust these limits over time.
• Service interruptions.Like any internet-dependent service, WhatsGen may experience downtime due to provider outages, scheduled maintenance, model updates, or third-party AI provider changes. Brief or transient interruptions do not entitle subscribers to refunds; see "Refunds & Cancellation" below for the refund policy.
• Third-party AI dependencies. WhatsGen uses DeepInfra as its cloud AI provider. On Android, chat replies are generated by DeepInfra. On both platforms, the optional analysis features (conversation reviews, custom persona generation, persona tweaks) use DeepInfra. On iPhone, chat generation and voice transcription happen entirely on-device and do not depend on any third-party provider. Service degradation of the cloud provider may affect Android chat and, on both platforms, the analysis features, but does not affect on-device iPhone chat.
• Voice input.Voice-to-text dictation is processed entirely on your iPhone via Apple's Speech Recognition framework — no dictation audio is uploaded, and no server-side transcription applies. Voice messages you deliberately record and send are stored in our backend for playback (see our Privacy Policy). Transcribed dictation text you choose to send counts as normal chat usage and is subject to the same fair-use limits described above.
• Initiative messages. Your AI personas may send AI-initiated outbound messages so conversations feel alive — this is included with your WhatsGen Pro subscription.

Payment & Auto-Renewal

• Payment will be charged to your Apple ID account at confirmation of purchase
• Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the selected plan
• Pricing is in USD and may vary by region based on Apple's currency conversion. Prices are subject to change with 30 days' notice to existing subscribers

Managing Your Subscription

• You can manage your subscription and turn off auto-renewal at any time in your device's app-store account settings after purchase: on iPhone, Apple Settings → [Your Name] → Subscriptions → WhatsGen; on Android, the Google Play Store app → your profile → Payments & subscriptions → Subscriptions → WhatsGen → Cancel subscription.
• Cancellation takes effect at the end of the current billing period — you retain Pro access until then
• No partial refunds are provided for unused subscription time

Refunds & Cancellation

ALL PURCHASES ARE FINAL. WhatsGen does not issue, process, or reimburse refunds under any circumstances.

• All WhatsGen subscriptions are sold and billed exclusively through the platform app store you purchased on — Apple's App Store on iPhone, or Google Play on Android — under that store's standard terms. Yap Studios never receives, processes, or stores your payment information
• Refunds are handled by the store you purchased through. On Android, request a refund via Google Play (play.google.com/store/account or the Google Play Help refund process; Google decides refund eligibility per the Google Play refund policy). On iPhone, you must request it directly from Apple using reportaproblem.apple.com ("Report a Problem"). Apple, in its sole discretion, decides whether to grant refunds and how much. Yap Studios has no ability to influence, appeal, or expedite that decision
• You expressly waive any right to dispute charges, initiate chargebacks, or file payment disputes against Yap Studios with your card issuer or bank, except to the extent such waiver is prohibited by applicable law. Initiating a chargeback in violation of this clause constitutes a material breach of these Terms and may result in immediate account termination without refund
• Cancelling your subscription stops future charges but does not trigger a refund for the current billing period. You retain Pro access until the end of the period you have already paid for
• Service degradation, downtime, AI-provider outages, global cost-cap events, model changes, or similar interruptions do not entitle you to a refund, pro-rata credit, or service extension. The App is licensed "as is" and "as available"

Our Intellectual Property

• The WhatsGen application, including its design, source code, AI persona characters, system prompts, branding, and all associated materials, is the intellectual property of Yap Studios and is protected by copyright, trademark, and other intellectual property laws
• The AI persona characters — including their names, personalities, communication styles, and system prompts — are proprietary and may not be copied, reproduced, or used outside of WhatsGen
• The WhatsGen name, logo, and visual identity are trademarks of Yap Studios

Your Content

• You retain ownership of the original messages you compose and send within WhatsGen
• AI-generated responses are not exclusively owned by any party — similar responses may be independently generated for other users
• By using WhatsGen, you grant us a non-exclusive, royalty-free license to process your messages solely for the purpose of providing and improving the Service

The App is licensed, not sold, to you for use strictly in accordance with these Terms, subject to the following:

• We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, as permitted by the Apple App Store Terms of Service
• This license does not allow you to use the App on any device that you do not own or control, and you may not distribute or make the App available to third parties
• This license will terminate automatically if you fail to comply with these Terms

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The AI-generated content will be accurate, complete, or reliable
• The results obtained from using the App will meet your expectations
• Any errors in the App will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL YAP STUDIOS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, REPUTATION, RELATIONSHIPS, EMOTIONAL DISTRESS, OR MENTAL ANGUISH, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, WHATSGEN — EVEN IF YAP STUDIOS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YAP STUDIOS' TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF WHATSGEN, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO YAP STUDIOS FOR THE SERVICE IN THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

This cap applies regardless of the number of claims and survives termination of these Terms. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you in full. In such jurisdictions, Yap Studios' liability is limited to the smallest amount permitted by law.

AI-Content Responsibility

You acknowledge and agree that:

• AI-generated responses in WhatsGen are produced by third-party large language models and may be inaccurate, biased, offensive, inappropriate, fabricated, or outright wrong
• You are solely responsible for any real-world actions you take based on AI-generated content, including decisions about dating, relationships, career moves, financial matters, medical concerns, mental health, legal issues, or any other domain
• WhatsGen is not a substitute for, and must not be used as, medical, psychiatric, psychological, legal, financial, or other professional advice. If you need professional help, consult a licensed professional in the relevant field
• Yap Studios disclaims all liability for harm, loss, distress, relationship damage, professional consequence, financial loss, or injury arising from your reliance on AI-generated content

You agree to indemnify, defend, and hold harmless Yap Studios, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from or related to:

• Your use of or access to WhatsGen
• Your violation of these Terms
• Your violation of any rights of a third party
• Any content you submit, create, or generate through the App
• Any real-world actions you take based on AI-generated content

Termination by You

• You may delete your account at any time through Settings → Account → Delete Account
• Account deletion is permanent, irreversible, and removes all your data including conversations, messages, and custom personas
• Important: Deleting your WhatsGen account does not automatically cancel your Apple subscription. You must separately cancel through Apple Settings → [Your Name] → Subscriptions

Termination by Us

• We may suspend or terminate your account immediately, without prior notice or liability, if you violate these Terms
• We may terminate inactive accounts (12+ months of inactivity) after providing 30 days' notice where possible
• We reserve the right to discontinue the Service with reasonable notice

Effect of Termination

• Upon termination, your right to use the App ceases immediately
• Your data will be deleted in accordance with our Privacy Policy
• Sections that by their nature should survive termination will survive, including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in New South Wales, Australia, and you consent to the personal jurisdiction of such courts.

Informal Resolution

Before filing any formal legal action, you agree to first contact us at support@whatsgen.app and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If informal resolution is unsuccessful, any dispute arising from these Terms shall be settled by binding arbitration in New South Wales, Australia in accordance with applicable arbitration rules. The arbitration shall be conducted in English.

Class Action Waiver

You agree to resolve disputes on an individual basis. You waive your right to participate in class actions, class arbitrations, or representative actions to the fullest extent permitted by law.

Exceptions

Nothing in this section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction for claims related to intellectual property infringement or unauthorized access.

The following additional terms apply to your use of WhatsGen as downloaded from Apple's App Store:

• These Terms are between you and Yap Studios only, and not with Apple Inc. ("Apple"). Yap Studios, not Apple, is solely responsible for the App and its content
• Apple has no obligation to furnish any maintenance and support services with respect to the App
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App
• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation
• In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Yap Studios, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary
• You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties

You must also comply with all applicable third-party terms of service when using the App, including your wireless data service agreement.

We may modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of these Terms
• For material changes, we will provide at least 30 days' notice through the App or via email before the changes take effect
• Your continued use of WhatsGen after changes take effect constitutes your acceptance of the updated Terms
• If you do not agree to updated Terms, you must stop using the App and may delete your account
