Terms of Service

By downloading, installing, accessing, or using WhatsGen ("the App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Yap Studios ("we," "us," or "our").

• You must be at least 13 years old to use WhatsGen. Users between 13 and 17 must have parental or guardian consent
• By using the App, you represent and warrant that you meet the age requirements and have the legal capacity to enter into these Terms
• If you do not agree to these Terms, you must not use the App

WhatsGen is an AI-powered conversation practice application designed to help users develop and refine their texting and social communication skills in a low-pressure, judgment-free environment.

Features

• AI Persona Conversations — Practice texting with AI-generated personas across four modes: Social, Dating/Rizz, Professional, and Language Practice
• Curated Personas — Access to a catalog of 45+ AI personas with distinct personalities, communication styles, and behavioral patterns
• Custom Personas — Create or customize AI personas based on your specific practice scenarios
• Voice Input — Dictate messages using speech-to-text transcription

Important Disclaimers

WhatsGen is designed for practice and entertainment purposes only. The App is not a substitute for:

• Professional therapy, counseling, or mental health services
• Legal, medical, financial, or relationship advice
• Real human relationships or social connections

You should not rely on AI-generated responses for real-world decisions. If you need professional help, please consult a qualified professional.

To use WhatsGen, you must create an account or continue as a guest.

• Authentication — You may sign in with Apple, sign in with Google, or continue as a guest with limited functionality
• Account accuracy — You are responsible for the accuracy of the information associated with your account
• Account security — You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access
• One account per person — Creating multiple accounts to circumvent usage limits, bans, or free tier restrictions is prohibited

You agree to use WhatsGen only for lawful purposes and in accordance with these Terms. You agree not to:

• Generate harmful content — Attempt to make AI personas generate content that promotes violence, hatred, discrimination, harassment, self-harm, or illegal activities
• Exploit AI systems — Attempt to bypass persona safety boundaries, extract system prompts, use prompt injection techniques, or manipulate AI personas into generating harmful, misleading, or inappropriate content
• Engage in illegal activity — Use the App to plan, facilitate, or discuss illegal activities, including but not limited to fraud, stalking, or harassment
• Harass or impersonate — Use conversations or persona features to harass, threaten, or impersonate real individuals
• Automate access — Use bots, scrapers, or automated tools to access the App, send messages, or extract data
• Reverse engineer — Decompile, disassemble, reverse engineer, or attempt to derive the source code of the App, its AI systems, or persona system prompts
• Circumvent restrictions — Bypass usage limits, paywalls, subscription requirements, or account restrictions through any means, including creating multiple accounts
• Redistribute content — Commercially exploit, sublicense, or redistribute AI-generated responses outside the App without authorization

Violation of this policy may result in immediate account suspension or permanent termination without notice or refund.

WhatsGen uses artificial intelligence (xAI's Grok API) to generate all persona responses. By using the App, you acknowledge and agree that:

• AI, not human — All persona responses are generated by artificial intelligence, not real humans. Personas are entirely fictional characters created for communication practice
• No professional advice — AI-generated responses do not constitute professional advice of any kind. This includes but is not limited to psychological, legal, medical, financial, relationship, or career advice
• No accuracy guarantee — AI responses may contain factual inaccuracies, inconsistencies, outdated information, or errors. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content
• Practice purposes only — The App is designed to help you practice communication skills. Results may not directly translate to real-world interactions with real people
• Content variability — AI personas may occasionally produce unexpected, off-character, or repetitive responses. We continuously work to improve quality but cannot guarantee perfect consistency
• No endorsement — Opinions, suggestions, or viewpoints expressed by AI personas do not reflect the views of Yap Studios and should not be attributed to us

Free Tier

• WhatsGen offers a free tier with 35 messages per day, access to a limited selection of AI personas, and up to 3 custom personas
• Free tier message limits reset daily at midnight
• Free tier limits are subject to change with reasonable notice

WhatsGen Pro Subscription

• WhatsGen Pro unlocks all AI personas, unlimited daily messages, and unlimited custom persona creation
• Monthly plan: $9.99 USD per month
• Annual plan: $79.99 USD per year (equivalent to $6.66/month)

Free Trial

• New subscribers may be eligible for a 3-day free trial of WhatsGen Pro
• The free trial provides full access to all Pro features during the trial period
• If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription at the selected plan price
• Free trials are limited to one per Apple ID

Payment & Auto-Renewal

• Payment will be charged to your Apple ID account at confirmation of purchase
• Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the selected plan
• Pricing is in USD and may vary by region based on Apple's currency conversion. Prices are subject to change with 30 days' notice to existing subscribers

Managing Your Subscription

• You can manage your subscription and turn off auto-renewal by going to your Account Settings on your device after purchase (Apple Settings → [Your Name] → Subscriptions → WhatsGen)
• Cancellation takes effect at the end of the current billing period — you retain Pro access until then
• No partial refunds are provided for unused subscription time

Refunds

• All purchases are processed through Apple. Refund requests must be made through Apple Supportin accordance with Apple's refund policies
• Yap Studios does not directly process payments or handle refunds

Our Intellectual Property

• The WhatsGen application, including its design, source code, AI persona characters, system prompts, branding, and all associated materials, is the intellectual property of Yap Studios and is protected by copyright, trademark, and other intellectual property laws
• The AI persona characters — including their names, personalities, communication styles, and system prompts — are proprietary and may not be copied, reproduced, or used outside of WhatsGen
• The WhatsGen name, logo, and visual identity are trademarks of Yap Studios

Your Content

• You retain ownership of the original messages you compose and send within WhatsGen
• AI-generated responses are not exclusively owned by any party — similar responses may be independently generated for other users
• By using WhatsGen, you grant us a non-exclusive, royalty-free license to process your messages solely for the purpose of providing and improving the Service

The App is licensed, not sold, to you for use strictly in accordance with these Terms, subject to the following:

• We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, as permitted by the Apple App Store Terms of Service
• This license does not allow you to use the App on any device that you do not own or control, and you may not distribute or make the App available to third parties
• This license will terminate automatically if you fail to comply with these Terms

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The AI-generated content will be accurate, complete, or reliable
• The results obtained from using the App will meet your expectations
• Any errors in the App will be corrected

Limitation of Liability

To the maximum extent permitted by applicable law, Yap Studios, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of or inability to use the App.

Our total aggregate liability for any claims arising from your use of WhatsGen shall not exceed the greater of (a) the amount you paid for the Service in the 12 months preceding the claim, or (b) one hundred US dollars ($100 USD).

You acknowledge that we are not responsible for any actions you take based on AI-generated content, including decisions about social interactions, relationships, or professional communications.

You agree to indemnify, defend, and hold harmless Yap Studios, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from or related to:

• Your use of or access to WhatsGen
• Your violation of these Terms
• Your violation of any rights of a third party
• Any content you submit, create, or generate through the App
• Any real-world actions you take based on AI-generated content

Termination by You

• You may delete your account at any time through Settings → Account → Delete Account
• Account deletion is permanent, irreversible, and removes all your data including conversations, messages, and custom personas
• Important: Deleting your WhatsGen account does not automatically cancel your Apple subscription. You must separately cancel through Apple Settings → [Your Name] → Subscriptions

Termination by Us

• We may suspend or terminate your account immediately, without prior notice or liability, if you violate these Terms
• We may terminate inactive accounts (12+ months of inactivity) after providing 30 days' notice where possible
• We reserve the right to discontinue the Service with reasonable notice

Effect of Termination

• Upon termination, your right to use the App ceases immediately
• Your data will be deleted in accordance with our Privacy Policy
• Sections that by their nature should survive termination will survive, including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in New South Wales, Australia, and you consent to the personal jurisdiction of such courts.

Informal Resolution

Before filing any formal legal action, you agree to first contact us at support@whatsgen.app and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If informal resolution is unsuccessful, any dispute arising from these Terms shall be settled by binding arbitration in New South Wales, Australia in accordance with applicable arbitration rules. The arbitration shall be conducted in English.

Class Action Waiver

You agree to resolve disputes on an individual basis. You waive your right to participate in class actions, class arbitrations, or representative actions to the fullest extent permitted by law.

Exceptions

Nothing in this section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction for claims related to intellectual property infringement or unauthorized access.

The following additional terms apply to your use of WhatsGen as downloaded from Apple's App Store:

• These Terms are between you and Yap Studios only, and not with Apple Inc. ("Apple"). Yap Studios, not Apple, is solely responsible for the App and its content
• Apple has no obligation to furnish any maintenance and support services with respect to the App
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App
• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation
• In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Yap Studios, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary
• You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties

You must also comply with all applicable third-party terms of service when using the App, including your wireless data service agreement.

We may modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of these Terms
• For material changes, we will provide at least 30 days' notice through the App or via email before the changes take effect
• Your continued use of WhatsGen after changes take effect constitutes your acceptance of the updated Terms
• If you do not agree to updated Terms, you must stop using the App and may delete your account
